Terms of Service

The agreement between us. Written plainly enough that you can read it before you sign.

Last updated 2 October 2026

1. Who you are contracting with

These Terms are between you (the "Client") and Creatrixe Solutions Limited, a company incorporated in British Columbia, Canada, which operates Brimeo ("Brimeo", "we", "us"). By opening an account, paying an invoice, or letting us put an agent on your phone line, you agree to them. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.

You must be at least 18 and located in the United States, and you must not make the agent available to callers outside the United States. Brimeo is operated from Canada but the service is offered to US businesses only.

2. What the service is

Brimeo builds and operates an AI voice agent that answers inbound calls to a number you control. Depending on your plan it may answer questions, qualify callers, book appointments in your calendar, send you summaries, send follow-up messages to people who contacted you, and route or transfer calls. The service creates a recording and a transcript of each call, available in your dashboard.

The setup fee covers discovery, building the call logic for your business, and testing it. It is charged once, is non-refundable once the build has started, and is separate from the monthly fee. The setup fee is waived on all plans for agreements signed on or before 31 December 2026.

3. Phone numbers

We will either host your existing number or assign you a forwarding number. If you leave and do not port a Brimeo-assigned number away within three months of termination, we may release or reassign it.

4. Fees, credits and cancellation

Monthly fees are charged in advance. Plans are month to month with no minimum term.

Call allowance and credits

Each plan includes a monthly allowance of call minutes. Beyond that, calls run on overage credits. One credit is one minute of call time.

  • Each plan includes a baseline of overage credits: 60 on Starter, 180 on Growth and 600 on Scale. Included credits replenish to that baseline at the start of each billing month and do not carry forward.
  • You can buy additional credits in packs: 20 credits for $10, 60 for $27, 120 for $48, or 200 for $75. Purchased credits never expire and carry forward until used.
  • Credits are consumed only after the monthly minute allowance is used, and included credits are used before purchased ones.
  • Auto top-up is switched off unless you turn it on. If you enable it, a further pack is bought automatically when your balance runs low so the service continues without interruption, and we email a receipt every time it is charged. You can switch it off again at any time.

When the allowance and credits run out

We notify you when you reach 80% and 100% of your monthly allowance, and again when your credit balance is low.

If auto top-up is on, a credit pack is purchased automatically and the agent keeps answering. If auto top-up is off and you exhaust both your monthly allowance and your overage credits, the agent stops answering calls until your allowance resets at the start of the next billing month or you buy more credits.

Cancellation and refunds

  • You can cancel at any time, effective at the end of the current billing period. Email is enough — we will not make you call anyone.
  • Monthly plans are non-refundable, and there are no credits for partial periods, unless these Terms say otherwise.
  • Unused credits are not refunded on cancellation, including purchased credits.
  • On cancellation you can export your call data for 90 days. After that it is deleted.
  • If a payment fails we may suspend the service until it is settled. We do not charge late fees or interest.
  • Prices are in US dollars and exclude any sales, use or other taxes that apply to you. Prices can change on 30 days' notice. Setup fees already paid are never re-charged.

Annual plan refunds

Annual plans are billed upfront for twelve monthly plan periods, each with its own usage quota. You may request a refund within 60 days of your initial purchase or any renewal.

  • If you request within the first 30 days, your refund will equal the amount you paid, minus the standard monthly price for one month, minus any payment processing fees we incurred on the transaction.
  • If you request between day 31 and day 60, your refund will equal the amount you paid, minus the standard monthly price for two months, minus any payment processing fees we incurred on the transaction.

"Standard monthly price" means the price of the same plan billed monthly, not the discounted annual rate. Each month that has started counts as used, whether or not the quota was consumed, and unused quota does not carry over. Credits, top-ups, overage charges, phone numbers, third-party carrier fees, and setup fees are non-refundable.

After 60 days, annual plans are non-refundable, but you may cancel at any time to prevent renewal, and your access will continue until the end of your term. We will always correct billing errors and refund charges for periods in which our service was materially unavailable. Nothing in this policy limits rights you have under applicable law.

5. What you are responsible for

You control what the agent says and to whom. That means you are responsible for:

  • Call recording consent. Recording laws vary by state and some require every party's consent. We provide configurable template disclosures and recommend enabling them on every call. We do not warrant that any template, default setting or configuration meets your legal obligations, and you rely on them at your own risk.
  • AI disclosure where your state or industry requires it.
  • Accuracy of what you give us — pricing, availability, services, policies. The agent repeats what you tell it.
  • Your own privacy notice covering the callers whose data you collect through the service, and responding to their privacy requests.
  • Not using the agent with callers under 16.

6. Acceptable use

You must not use Brimeo to:

  • Make automated outbound calls or texts to people who have not contacted you first.
  • Process Prohibited Data: Protected Health Information, payment card numbers, government identification numbers, account credentials, or other sensitive financial data.
  • Configure the agent to ask callers for health information, or to record it as structured data. Callers sometimes volunteer it; the agent must not solicit it.
  • Impersonate a named individual, or configure the agent to deny that it is AI.
  • Mislead callers, or operate anything unlawful, fraudulent, harassing or discriminatory.
  • Promote adult services, gambling, counterfeit goods, or anything illegal where offered.
  • Resell or white-label the service without a written agreement with us.
  • Reverse engineer, scrape or interfere with the service.

We can suspend an account that breaches this section, and will tell you why.

7. Inbound only

Brimeo answers calls. It does not place them.

Automated outbound calling is regulated under the TCPA, and the FCC confirmed in February 2024 that AI-generated voices count as artificial or prerecorded voices for that purpose, meaning outbound AI calls need the same prior consent as robocalls, with statutory damages per call. Follow-up messages are limited to people who contacted you first: a caller you missed, an appointment already booked, a visit that already happened. If you use SMS follow-up you are responsible for consent and opt-out handling, and you indemnify us for any failure to comply.

Because Brimeo is operated from Canada, commercial electronic messages sent through the service are also subject to Canada's Anti-Spam Legislation (CASL), which applies to messages sent from Canada regardless of where the recipient is. CASL requires consent, clear identification of the sender and a working unsubscribe mechanism. Our follow-up messaging is limited to people who contacted you first, which is the narrowest footing available under both CASL and the TCPA.

We will not configure outbound campaigns, and we will not remove this restriction on request.

8. Healthcare and health information

Brimeo is not a HIPAA business associate and does not sign Business Associate Agreements. Protected Health Information is Prohibited Data and must not touch the service. If you are a covered entity or business associate under HIPAA, the service is not appropriate for calls involving patient health information.

9. Your data

Call recordings, transcripts, contact details and everything else the agent captures on your line belong to you. You grant us the licence needed to host, process and display that data so the service works, and for nothing else.

We do not use your data to train AI models, ours or anyone else's, and we do not sell it. Our Data Processing Addendum forms part of these Terms.

10. What AI can and cannot do

An AI agent will sometimes get something wrong. It may mishear a name, misjudge a request, or fail to answer a question outside what it was given. We build handoff paths for exactly that reason and we test against it, but we cannot warrant that every call will be handled correctly. You are responsible for reviewing outputs and for the consequences of relying on them.

Do not use the agent as the only channel for emergencies, or for anything with a legal or material impact on a person — credit, employment, housing, insurance, medical or legal decisions. If your business receives urgent or safety-critical calls, keep a human escalation path.

The service depends on telephony carriers and third-party platforms we do not control. We aim for high availability and will tell you about incidents, but we do not offer an uptime guarantee unless it is written into a separate agreement with you.

11. Intellectual property

We own the platform, the software, the agent configurations we build, and any general know-how. You own your business content and your call data. Nothing here transfers ownership either way. Any feedback you give us, we may use freely.

12. Liability and indemnity

To the extent the law allows, our total liability under these Terms is limited to the fees you paid us in the three months before the claim, or US$100 if no fees were paid. We are not liable for lost profits, lost business, or indirect losses. The service is provided "as is".

You will indemnify us against claims arising from your use of the service in breach of sections 5, 6 or 7 — in particular claims about recording consent, AI disclosure, SMS, or contact you instructed us to make.

Nothing here limits liability for fraud, or anything else that cannot be limited by law.

13. Termination

Either of us can end the arrangement with 30 days' notice. We can suspend or terminate immediately for non-payment, a breach of acceptable use, or use we reasonably believe is fraudulent or illegal.

On termination we stop answering your calls, you remove your call forwarding, and calls ring where they rang before. Your data stays available to export for 90 days, then is deleted.

14. Disputes and governing law

Talk to us first. Before starting anything formal, email legal@brimeo.io and give us 30 days to resolve it. Most things can be sorted this way.

Governing law. These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, without regard to conflict of law rules. The courts of British Columbia have exclusive jurisdiction, and you and we both submit to their jurisdiction. Any claim must be brought within one year of the events giving rise to it.

15. General

We may update these Terms. Material changes get 30 days' email notice to account holders, and continuing to use the service after that means you accept them. If a provision is unenforceable, the rest stands. We may assign these Terms; you may not without our consent. Notices go to the email on your account.
